A. Introduction:
1. History and Focus, Purpose and Mission:
History: XXXX began in Southeast Michigan in 1985 making Michigan one of first five XXXX affiliates in the U. S. Susan Smith, a low-income single-parent, the founder of XXXX of Michigan, her two children were owed over $16,000 in back child support. The local Friend of the Court had failed to act on her case for over two years. She organized parents in southeast Michigan to advocate for improved child support enforcement services. Within two years, affiliates were organized in Washtenaw, Wayne, and Oakland Counties. Michigan now has 11 affiliates including Eaton, Ingham, Genesee, Livingston, Shiawasse, and Washtenaw. Southeastern Michigan XXXX affiliates successfully advocated for income withholding laws, child support guidelines to determine the amount of support paid, a formal complaint/ process for families having problems with the Friend of the Court, annual review of Friend of the Court complaints by each the Chief Administrative Judge in each Circuit Court, and laws requiring establishment of County Friend of the Court Advisory Committees.
Focus: There are 1.1 million children in Michigan owed $7.1 billion in unpaid back child support. XXX X is membership organization. Members work together to impact public policy, bringing about institutional change by empowering single-parents to organize local affiliates in their communities. When child support is combined with available earned income, many low-income, single-parent families obtain and are able to maintain self-sufficiency. Welfare Reform laws, especially the timelimit provision, have made receiving child support payments to supplement family income essential. XXXX provides single-parents a unified voice to advocate for institutional change which truly benefits their family. XXXX Mission: To assist disadvantaged children affected by parents who fail to meet legal and moral child support and visitation obligations.
Purpose : To assure that children receive child support payments.
- This proposal is for:
XXXX affiliates in Eaton, Ingham, Genesee, Livingston, Shiawasse, and Washtenaw counties, and new affiliates to organize parents to advocate for:
- Families to receive notice by Friend of the Courts( FOC) and Family Independence Agency (FIA) about child support enforcement services required to be provided under federal and state laws; and their right to file a formal complaint if services are not provided by Local Friend of Court and FIA, Family Independence Agency.
- A statewide computer system which meets federal law requirements, contains accurate data, and is "user friendly"to families. Michigan's troubled CSES computer system is the most expensive in nation, costing $1 billion by its completion in 2007. FIA failed to obtain federal certification of the computer in November 2002. Penalties against Michigan by the federal government for failure to have a certified computer system are now over $50 million.
Release of undistributed child support payments to families. The FIA reports holding $44 million in child support payment at end of 2001; the state reports over 2 million sent to unclaimed funds in the past two years. Also, large amounts of child support ($6.2 million) are being held in CSES, the state computer system, in suspense ledger and hold accounts, because the computer can not identify how to distribute payments. The reasons for these funds are unknown.
2. Community Served: About 70% of XXXX members are single mothers who live slightly above or below the poverty level. Overall, 50% of single-parent families owed child support live at or below the poverty line. XXXX uses the U.S. Department of Health and Human Services Poverty Guidelines to define poverty: $11,060 for a family of two; $13,880 for a family of three; $16,700 for a family of four; $19,520 for a family of five; $22,340 for a family of six; $25,160 for a family of seven; $27,980 for a family of eight; and $2,820 additional for each person above a family of eight. 50% of European-American children, 60% of Hispanic-American children, and 70% of African-American children growing up in single female head- of- households who are entitled to child support are live in poverty.
B. Organization Structure and Membership
1. Community: In Southeast Michigan counties in the Lansing Diocese there are about 80,000 families with cases at local Friend of the Court offices. These families will directly benefit from XXXX work.
- Policy Making Board
: Members of the Southeast Michigan Project Policy Making Board are Chapter Coordinator's who are elected annually by each chapter in the Lansing Diocese. Project Board members are single-parents whose children are entitled to child support. Current part-time staff located in Ann Arbor will provide staffing for this Policy Making Board. XXXX affiliates in Southeast Michigan voted to submit this and other grant proposals.
- Membership:
The majority of XXXX members are single-parents with two children who are owed an average of $10,000 in back child support. Child support payments, when received, make up 26% of annual income. The average XXXX member's annual income is $14,000.XXX X isis successfull, 80% of our members collect support payment with in six months of getting involved. Collecting child support enables low-income, single-parents to obtain and sustain self-sufficiency when joined with earned income. Over 50% oXXXX members have received welfare in the past, 23% oXXXX Southeast Michigan members are currently receiving cash benefits (down from 54% pre- welfare reform). Many continue to receive food stamps, housing assistance, medical, and/or day care assistance. AlXXXX members are eligible and encouraged to become active members of local chapters. Executive Committees (Local Chapter Policy Making Boards) are established by local affiliates and responsible for day-to-day operations of local chapters .XXXX membership dues are $0- $10 for income of $10,000 or less; $10- $15 for incomes $10,000 -$15,000; $15- $20 for incomes $15,000- $20,000 and $25 per year for incomes over $20,000.XXX X isis a membership-governed organization. All activities of the local affiliates are discussed and voted on by the membership at chapter meetings. Each chapter elects a representative to participate in the State Coordinating Council that votes on statewide activities. All members are eligible to be elected to the National Board XXXX members elect the National Board. 50% of the members of the XXXX National Board of Trustees are low-income, single, female head-of- household, and 30% are minorities.
C. Goals and Implementation Plans
- Strengthening existing XXXX affiliates and establishing new affiliates to organize parents to be effective advocates for their children
1st Half
- Hold Leadership Training and Strategy Sessions for X XXX leaders in existing and recruit potential leaders for Jackson, Clinton, Hillsdale and Lenawee counties for XXXX membership in those areas. Topics to include: organizing skills, media, outreach, and issues about notice of rights and complaint process, statewide computer system, undistributed funds..
2nd Half
- Carry out Action or Monitoring
Measurable Outcome: Each chapter participates in Leadership and Strategy Meeting.
2. Families to receive notice by Friend of the Courts (FOC) and Family Independence Agency (FIA) about child support enforcement services required to be provided under federal and state laws and their right to file a formal complaint if services are not provided by local Friend of Court and FIA, Family Independence Agency
1st Half
- XXXX affiliates to advocate at meeting with Michigan public officials for written materials, kiosks, and posters to be displayed in each FOC and FIA office notifying parents of their rights
2nd Half
- XXXX affiliates will organize an action to put pressure on the public officials to comply or establish a monitoring system to ensure they comply with any agreement made with ACES.
Measurable Outcomes: Notice given to parents of right to services and complaint process availability
3. A statewide computer system which meet federal law requirements, contains accurate data, and is "user friendly" to families.
1st Half
- Based the findings of the investigation XXXX will advocate for implementation timetable to make corrections needed or if no investigation occurs XXXX organize an "action" to put pressure on the Governor to correct computer problems.
Measurable Outcome: Correction of computer problems
- Release of undistributed child support payments to families to which they are owed
1st Half
- Local affiliates will identify families who are victims of held payments and empower them to speak to the media, public officials, and legislators to educate them about the issue.
2nd Half
- XXXX affiliates will evaluate the response of public officials to determine if an action or lawsuit is needed or if a monitoring system is needed to ensure prompt distribution of child support payments.
